Terms of Service

Effective date: 30th August 2026

Welcome to Mandarin Mahjong.

These Terms of Service apply to your use of mandarinmahjong.com and to any order placed through our website.

Mandarin Mahjong is operated by [insert legal entity name], ABN [insert ABN], trading as Mandarin Mahjong, with its principal place of business in New South Wales, Australia.

Throughout these Terms, “Mandarin Mahjong”, “we”, “us” and “our” refer to the business operating this website. “You” and “your” refer to the person accessing the website or purchasing from us.

By accessing our website or placing an order, you agree to these Terms together with our:

  • Shipping and Refund Policy
  • Privacy Policy
  • Any product-specific conditions displayed before purchase

Please read these documents carefully before placing an order.

1. Using Our Website

You may use our website for personal and lawful purposes.

You must not use the website:

  • For unlawful, fraudulent or misleading activities
  • To interfere with the website’s security or operation
  • To introduce viruses, malicious code or harmful technology
  • To collect information about other users without permission
  • To copy or scrape website content for unauthorised commercial purposes
  • To place false, speculative or fraudulent orders
  • To infringe our rights or the rights of another person

We may restrict or suspend access where we reasonably believe the website is being misused, subject to applicable law.

2. Eligibility to Purchase

You must be legally capable of entering into a binding contract to place an order.

Where you are under the age of majority in your location, an order must be placed or approved by a parent or legal guardian.

Some products contain small parts and may not be suitable for young children. Please follow all age recommendations, warnings and safety information shown on the product page or packaging.

3. Product Information

We take care to describe and present our products as accurately as possible.

Colours may appear differently depending on photography, lighting, screen settings and device displays. Small variations may also occur in colour, translucency, pattern placement, engraving, printing, texture or finish due to materials and manufacturing processes.

These subtle variations are part of the character of the product and are not considered defects unless they materially affect its quality, appearance or intended use.

Product images may include decorative or styling items that are not included with the purchase. The product description and What’s Included section will confirm what is supplied.

Measurements and weights are approximate unless expressly stated otherwise.

4. Prices and Currency

Product prices are displayed in the currency selected on the website or shown at checkout.

Prices may include or exclude taxes depending on your location and the information displayed at checkout. Shipping charges, customs duties, import taxes and other applicable costs will be shown or described before the order is completed where reasonably possible.

We may update our prices at any time. Price changes will not affect an order we have already accepted unless both parties agree or a correction is required by law.

Discount codes and promotional offers:

  • Must be used within their stated validity period
  • Cannot be redeemed for cash
  • Cannot usually be combined unless expressly permitted
  • May be subject to product, location, customer or minimum-spend conditions

5. Placing an Order

When you place an order, you are offering to purchase the selected products under these Terms.

After completing checkout, you will receive an order confirmation email. This confirms that we have received your order but does not necessarily mean it has been accepted for fulfilment.

We may need to contact you to verify payment, delivery information or other order details before accepting or dispatching the order.

We may decline or cancel an order before dispatch for a legitimate reason, including where:

  • The product is unavailable
  • Payment has not been authorised
  • The delivery address cannot be serviced
  • The order appears fraudulent or unauthorised
  • A material pricing or product-information error has occurred
  • A purchase limit has been exceeded

Where we cancel an order after payment has been received, we will refund the amount paid for the cancelled products.

We may apply reasonable purchase limits to limited-edition products, launches or promotional offers so that more customers have an opportunity to purchase.

6. Payment

Payment must be made using one of the payment methods available at checkout.

By submitting your payment information, you confirm that:

  • The information provided is accurate
  • You are authorised to use the selected payment method
  • Sufficient funds or credit are available
  • You authorise us and our payment providers to process the transaction

Payments may be processed by third-party providers, whose own terms and privacy practices may also apply.

Where a payment is declined, reversed or identified as unauthorised, we may pause or cancel the order.

7. Pre-Orders

Products offered for pre-order will include an estimated dispatch timeframe on the relevant product page.

Estimated dates are provided in good faith but may change due to manufacturing, quality-control requirements, freight, customs or circumstances outside our reasonable control.

A pre-order may be cancelled for a full refund within 14 calendar days after the date it was placed, provided it has not already been dispatched.

After this period, the pre-order is considered confirmed and generally cannot be cancelled before dispatch, except where:

  • Required by applicable consumer law
  • We agree otherwise
  • A significant delay or material product change gives rise to a cancellation right

Where a pre-order is materially delayed, we will provide an update and any options required by applicable law.

Orders containing both in-stock and pre-order products may be held until all products are ready unless separate shipping has been arranged.

Further details are available in our Shipping and Refund Policy.

8. Shipping and Delivery

Available shipping destinations, charges, processing periods and estimated delivery timeframes are explained in our Shipping and Refund Policy.

Please ensure that your delivery details are complete and accurate before placing an order.

Additional costs arising from an incorrect address, an uncollected parcel, a refused delivery or unpaid import charges may be your responsibility, except where applicable law provides otherwise.

Delivery timeframes are estimates unless expressly stated as guaranteed. Delays may occur due to carriers, customs, severe weather, peak periods, local disruptions or circumstances outside our reasonable control.

Responsibility for the product passes to you when it is delivered to you or to a person authorised to receive it, subject to applicable law.

9. International Orders

International orders may be subject to customs duties, import taxes, brokerage fees or local handling charges.

Where these charges are not included at checkout, they are the purchaser’s responsibility. Customs authorities determine the amount charged and the time required for clearance.

We cannot undervalue an order, misrepresent the nature of the goods or declare a commercial purchase as a gift.

Further information is available in our Shipping and Refund Policy.

10. Returns, Exchanges and Refunds

Returns, exchanges, return shipping costs, refund eligibility and refund procedures are governed by our Shipping and Refund Policy.

Please contact us before returning any product so that we can provide approval and the correct return instructions.

Unless otherwise required by applicable consumer law:

  • The purchaser is responsible for return costs where the product is not damaged, faulty, incorrect or incomplete
  • Returns originating outside the United States must be sent to our nominated return location in Australia
  • Eligible orders that received free shipping may have the actual outbound shipping cost deducted from the refund
  • Returned products must meet the eligibility and condition requirements stated in our Shipping and Refund Policy

These conditions do not limit any mandatory rights you may have under applicable consumer law.

11. Damaged, Faulty, Incorrect or Incomplete Products

Please contact us promptly if a product arrives damaged or faulty, is incorrect, or contains missing components.

We may request photographs, video, packaging information or other reasonable evidence so that we can assess the issue and arrange an appropriate remedy.

Depending on the circumstances and applicable law, the remedy may include a repair, replacement, replacement component, partial refund or full refund.

Detailed procedures are contained in our Shipping and Refund Policy.

Nothing in these Terms or our Shipping and Refund Policy limits any consumer guarantee or mandatory legal remedy.

12. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the nature of a problem, you may be entitled to a repair, replacement, refund or compensation in accordance with applicable law.

Nothing in these Terms or any Mandarin Mahjong policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

Our voluntary return arrangements operate in addition to your rights under the Australian Consumer Law. Any return period stated in our policies does not replace or shorten your rights in relation to faulty or non-compliant products.

13. European Economic Area and United Kingdom Customers

Customers in the European Economic Area or United Kingdom may have statutory cancellation and consumer rights that apply to eligible online purchases.

The applicable notice periods, return procedures, delivery-cost refunds and exclusions are explained in our Shipping and Refund Policy.

Where mandatory European Economic Area or United Kingdom consumer law conflicts with these Terms or another Mandarin Mahjong policy, the applicable mandatory consumer protection will take priority.

14. Gift Cards

Gift cards, where available:

  • May only be used through the Mandarin Mahjong store
  • Cannot be exchanged for cash except where required by law
  • Cannot be used to purchase another gift card unless expressly permitted
  • Should be protected like cash, as we may be unable to replace a lost or stolen code
  • Are subject to any expiry rules displayed at purchase and applicable law

Where the value of an order exceeds the gift-card balance, the remaining amount must be paid using another accepted payment method.

15. Product Care and Use

Please follow any care, cleaning, storage and safety instructions supplied with the product.

Mandarin Mahjong is not responsible for damage caused by:

  • Misuse or accidental impact
  • Improper cleaning products or methods
  • Prolonged exposure to heat, sunlight or moisture
  • Incorrect storage
  • Modification or unauthorised repair
  • Ordinary wear resulting from regular use

This section does not limit rights relating to a manufacturing fault or any consumer guarantee that applies by law.

16. Intellectual Property

Unless otherwise stated, all content appearing on our website belongs to or is licensed to Mandarin Mahjong, including:

  • Brand names and logos
  • Mahjong tile artwork and designs
  • Product and packaging designs
  • Photographs, videos and illustrations
  • Written content and product descriptions

You may view and use the website for personal, non-commercial purposes.

Purchasing a product does not transfer ownership of any intellectual property embodied in its design or artwork.

17. Reviews, Photographs and Other Submitted Content

Where you submit a review, photograph, comment or other content to us, you confirm that:

  • You created it or have permission to submit it
  • It does not infringe another person’s rights
  • It is not unlawful, misleading, abusive or defamatory
  • It does not contain malicious code or unauthorised personal information

You retain ownership of your submitted content.

By submitting content for publication, you grant Mandarin Mahjong a non-exclusive, worldwide and royalty-free licence to display, reproduce and share that content for the purpose of operating and promoting our business, including through our website, email communications and social media.

We are not required to publish submitted content and may remove content that breaches these Terms.

18. Third-Party Services and Links

Our website may use or link to third-party services, including payment processors, shipping carriers, review platforms, social media networks and technology providers.

Third-party websites and services are operated independently and may be subject to their own terms and privacy policies.

We are not responsible for third-party content, availability or conduct, except to the extent that responsibility cannot legally be excluded.

19. Privacy

We handle personal information in accordance with our Privacy Policy and applicable privacy laws.

By using the website or placing an order, you acknowledge that certain information may be shared with service providers where reasonably necessary to:

  • Process payments

  • Provide customer support
  • Prevent fraud
  • Operate and improve the website
  • Meet legal and regulatory requirements

20. Website Availability

We aim to keep our website accurate, secure and available, but uninterrupted access cannot be guaranteed.

We may temporarily suspend or update parts of the website for maintenance, security, upgrades or operational reasons.

We are not responsible for temporary interruptions outside our reasonable control, except where liability cannot legally be excluded.

21. Limitation of Liability

Nothing in these Terms excludes or limits any liability, consumer guarantee or legal remedy that cannot lawfully be excluded or limited.

To the maximum extent permitted by law, Mandarin Mahjong is not responsible for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

Where our liability may lawfully be limited, it will be limited to the amount reasonably connected with the affected order or service.

This section does not exclude liability for fraud, wilful misconduct, personal injury caused by negligence or any other liability that cannot legally be excluded.

22. Events Outside Our Reasonable Control

We are not responsible for delays caused by events outside our reasonable control, including:

  • Natural disasters
  • Severe weather
  • Industrial action
  • Transport disruption
  • Border closures
  • Customs delays
  • Government action
  • Infrastructure failure
  • Widespread carrier interruptions

Where such an event materially affects an accepted order, we will take reasonable steps to minimise the delay and keep you informed.

Where we cannot fulfil an order, we may cancel the affected portion and provide a refund. Nothing in this section limits any mandatory consumer right.

23. Resolving Concerns

We hope every experience with Mandarin Mahjong is a positive one.

Please contact us first if you have a concern about an order, product or service. We will review the matter carefully and make a genuine effort to find a fair solution.

Please submit your enquiry through our Contact Us page and include your order number, where applicable, together with a clear description of the matter.

Please include your order number and a clear description of the matter.

Nothing in this section prevents you from contacting a consumer-protection authority, tribunal or court.

24. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and Mandarin Mahjong submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.

This section does not prevent a customer from relying on mandatory consumer protections or bringing a claim in another jurisdiction where applicable law permits.

25. Changes to These Terms

We may update these Terms to reflect changes to our website, products, business practices or legal obligations.

Updated Terms will be published on this page with a revised effective date.

The Terms applying to an order will generally be the version available when the order was placed, unless a later change is required by law or agreed between us.

26. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be interpreted or removed only to the minimum extent necessary.

The remaining provisions will continue to apply.

27. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

28. Entire Agreement

These Terms, together with our Shipping and Refund Policy, Privacy Policy and any product-specific conditions presented before purchase, form the agreement between you and Mandarin Mahjong regarding your use of the website and purchases from us.
